MANUAL PREPARED IN TERMS OF SECTION 51 OF THE PROMOTION OF ACCESS TO INFORMATION ACT, NO 2 OF 2000, FOR THE INSTITUTE FOR SECURITY STUDIES


A INTRODUCTION TO ENTITY


The Institute for Security Studies (the ISS) is a registered not-for-profit Trust with registration number T1992/91, governed by trustees and funded by donors for achieving project goals. The Company Secretary at the ISS has been tasked to attend to all matters relating to this Act.

B PARTICULARS IN TERMS OF THE SECTION 51 MANUAL


This manual has been completed in accordance with the Promotion of Access to Information, Act 2 of 200 (the Act) and applies to the identified entity.

2. The Section 10 Guide on how to use the Act


Any person who wishes to exercise any right contemplated in the Promotion of Access to Information Act, 2 of 2000, may obtain a copy of the information guide issued by the Human Rights Commission in all official languages, from the Human Rights Commission, tel (011) 484 8300, fax (011) 484 7149.

3. Facilitation of a request for access to information, subjects on which the ISS holds records and the categories of records held.


Information, which is not readily available as indicated in paragraph 4 of this manual, may be requested in accordance with the procedure prescribed in terms of the Act. Copies of the prescribed forms to be completed for submitting a request are available from the ISS.

4. Information held


4.1 Information / documents available in accordance with other legislation (Section 51(1)(d) of the Act)

The ISS keeps information / documents in accordance with the following legislation (**please note this list is not exhaustive):
  • Income Tax Act, 58 of 1962 (Section 75)
  • Value-Added Tax Act, 89 of 1991 (Section 65)
  • Unemployment Insurance Act, 30 of 1966 (Section 32)
  • Basic Conditions of Employment Act, 75 of 1997 (Section 31)
  • Employment Equity Act, 55 of 1998 (Section 26)
  • Compensation for Occupational Injuries and Diseases Act, 130 of 1993 (Section 97)
  • Insolvency Act, 24 of 1936 (Section 134 and 155)
  • Occupational Health and Safety Act, 85 of 1993
  • Skills Development Act, 97 of 1998.

4.2 Personnel Records

 

These include:

  • Any personal records provided to the ISS by their personnel;
  • Any records a third party provided to the ISS about any of their personnel;
  • Conditions of employment and other personnel-related contractual and quasi-legal records;
  • Internal evaluation records; and
  • Other internal records and correspondence.

4.3 Other Parties

The ISS may possess records pertaining to other parties, including without limitation, contractors, suppliers, service providers and donors. Alternatively, such other parties may possess records that can be said to belong to the ISS.

5. Categories of records: automatic disclosure in terms of the Act


The ISS publishes research papers and articles from time to time as part of its function. Publications are listed and can be purchased from the ISS via the Internet website. This information is automatically available from the ISS without a person having to request access in terms of the Act.

6. Categories of records: voluntary disclosure in terms of the Act


Any request made for information must be requested on the prescribed form and in accordance to Section 53 of the Act and the prescribed fee will be charged for records so disclosed. Notwithstanding compliance with Section 50 of the Act, a request may be declined in accordance with one of the prescribed grounds as set out in the Act.

7. Requesting Procedure


A person wanting access to records must complete the necessary prescribed form. The request form can be accessed on www.sahrc.org.za. The request form must be sent to the address of fax number provided in clause 1 and marked for the attention of the Human Resources Officer. The Company Secretary will process the request and inform the requester of the fees (if any) that are payable and the different procedures that must be followed until the request is finalised. NOTE: Access to certain information may be or must be denied on the grounds as set out in the Act.

8. Availability of the Manual


Copies of this manual are available for inspection, free of charge, at the ISS and copies are also available from the South African Human Rights Commission, from the Government Printer and also on the ISS website.
